ClaimBeacon Terms & Conditions

These Terms and Conditions (“Terms”) form the agreement between ClaimBeacon (“we”, “our”, “us”) and you, the customer (“you”, “customer”), regarding the use of our services. By using our website or engaging our services, you accept these Terms. If you do not agree, you should not use our services.
1. Who We Are
ClaimBeacon helps air passengers exercise their rights when flights are delayed, canceled, overbooked, or otherwise disrupted. We facilitate the handling of compensation claims against airlines under applicable passenger rights regulations (such as EU Regulation 261/2004, the Montreal Convention, UK 261, and similar laws worldwide).
We are not a law firm and do not provide legal advice. When necessary, we may work with licensed attorneys or third-party partners to pursue claims on your behalf.
2. Definitions
For clarity in these Terms:
“Claim” – a request for monetary compensation, refund, damages, or settlement from an airline.
“Compensation Service” – our service to manage and pursue your claim against an airline.
“Eligible Claim” – a claim that we, at our discretion, decide to pursue.
“Flight Compensation” – any money, vouchers, credits, or other benefits obtained from the airline.
“Legal Action” – formal escalation of a claim via court proceedings, regulators, or external lawyers.
“Service Fee” – our fee payable if we successfully obtain compensation for you.
“Legal Action Fee” – an additional fee payable if Legal Action is required and compensation is secured.
“Authority Document” – a power of attorney, assignment, or other authorization form that allows us to act on your behalf.
“Fellow Passenger” – any other traveler included in your claim submission (e.g. family or group bookings).
3. Nature of Our Services
Our services include:
Eligibility Assessment – We review your flight details and determine whether your claim appears valid.
Claim Handling – We prepare and submit the claim to the airline and manage communications.
Negotiation & Settlement – We may negotiate with airlines for a settlement.
Escalation – If needed, we may escalate the claim to legal proceedings or national enforcement bodies.
Goodwill Requests – Where legal rights are unclear, we may request compensation as a goodwill gesture.
Limitations: We cannot guarantee success. Compensation outcomes depend on applicable law, the airline’s behavior, and available evidence.
4. Using Our Services
By using our services, you confirm that you:
Are at least 18 years old and legally able to enter into contracts.
Are the passenger affected by the disruption, or are legally authorized to act for the passenger.
Provide accurate and complete information.
Have not authorized any other company, lawyer, or third party to pursue the same claim.
If you represent a minor or another passenger, you must provide proper authorization (such as a signed power of attorney).
5. Customer Responsibilities
To allow us to process your claim, you agree to:
Sign and return any Authority Documents we request.
Provide all necessary flight documents (e.g. booking confirmation, boarding pass, ID copies if required).
Immediately forward to us any communication you receive from the airline regarding the claim.
Not accept or negotiate directly with the airline without informing us.
If you receive payment or compensation directly from the airline after engaging us, you remain liable for our Service Fee and, where applicable, Legal Action Fee.
6. Fees & Payment
No win, no fee. We only charge if your claim is successful.
Service Fee: A percentage of the compensation received, as published on our website at the time you engage us.
Legal Action Fee: If legal escalation is required, an additional percentage fee applies, payable only if successful.
Fees are deducted from the compensation amount before funds are transferred to you.
If compensation is paid directly to you by the airline, you must pay us the applicable fees within 14 days of receipt.
7. Legal Action
If an airline refuses to pay compensation after our initial efforts, ClaimBeacon may, at its discretion, escalate the matter by:
Submitting the claim to a regulator or national enforcement body.
Engaging contracted lawyers to pursue the case in court.
Filing legal complaints or joining class actions where applicable.
You authorize us to share your case details with third parties (such as attorneys) for the purpose of pursuing Legal Action.
If Legal Action is pursued and successful, our Legal Action Fee will apply in addition to the Service Fee.
If Legal Action is unsuccessful, you will not be charged for any costs we incurred. We cover the risk.
8. Settlements
ClaimBeacon may, at its discretion, accept or reject settlement offers from airlines on your behalf.
Where you have signed an assignment form transferring the claim to us, we are the legal owner of the claim and can decide on settlements.
Where you authorized us under a power of attorney, you agree that we may act in your name and accept settlements without needing further approval.
Settlement payments may be monetary or in kind (e.g. vouchers, credits). We will only accept non-cash settlements if we believe they provide fair value.
9. Goodwill Claims
In certain jurisdictions where air passenger rights are less developed or where regulations do not clearly cover your case, ClaimBeacon may attempt to request compensation as a goodwill gesture from the airline.
Goodwill compensation may be in the form of cash, vouchers, loyalty points, or other benefits.
You agree that our fees apply equally to goodwill outcomes.
10. Withdrawal & Termination
Your Right to Withdraw
If you are a consumer in the EU, EEA, or UK, you may withdraw from this agreement within 14 days of signing, free of charge, provided that:
No claim has been accepted or confirmed by the airline; and
No service has already been substantially performed by us (e.g. filing your claim).
To withdraw, you must notify us in writing (email or letter).
Termination by You
After 14 days, you may terminate your agreement with ClaimBeacon at any time. However:
If the airline has already agreed to pay compensation, you remain liable for our Service Fee.
If Legal Action has started, you remain liable for both Service Fee and Legal Action Fee if compensation is later obtained.
Termination by ClaimBeacon
We may terminate the agreement if:
We believe the claim has no realistic chance of success.
You provide false, misleading, or incomplete information.
You negotiate directly with the airline without our involvement.
You breach these Terms in a way that prevents us from continuing.
11. Data Protection & Privacy
We take the protection of your personal data seriously. All personal data collected and processed in connection with your claim will be handled in line with applicable data protection laws, including the General Data Protection Regulation (GDPR).
Your information will only be used for the purpose of managing your claim.
We may share your data with contracted third parties (lawyers, IT providers, payment processors) only as necessary.

12. Limitation of Liability
ClaimBeacon will use reasonable care and skill in handling your claim but cannot guarantee success.
We are not liable for indirect or consequential losses (such as loss of time, missed connections, or emotional distress).
Our liability for any direct losses is limited to the amount of compensation obtained for you.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
13. Third-Party Services
Our website or communications may include references to third-party services (e.g. insurance providers, booking platforms). These services are operated independently of ClaimBeacon.
We do not endorse or assume liability for any third-party service.
If you choose to use them, you do so at your own risk and subject to their terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of Germany.
Disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
If any provision of these Terms is found invalid, the remainder shall remain enforceable.
15. Final Provisions
ClaimBeacon reserves the right to amend these Terms at any time. Updated versions will be published on our website.
The version in force at the time you engaged our services applies to your claim.
These Terms form the entire agreement between you and ClaimBeacon.
You may not transfer your rights under these Terms without our consent. ClaimBeacon may assign its rights to affiliated companies or authorized third parties.
