Flight Departed Early? Here's When You Can Claim Compensation

Air travel is already stressful enough, but what happens when your flight leaves earlier than scheduled—and you miss it altogether? While most people are aware of compensation rights for delayed or canceled flights, many don’t realize that early departures can also qualify for compensation under European regulations.

Thanks to a precedent-setting case at the European Court of Justice, passengers now have the right to claim compensation if their flight was rescheduled and departed more than one hour earlier than the original departure time.


When Does an Early Departure Qualify for Compensation?

Airlines are expected to inform passengers of changes to their flight schedule at least 14 days in advance. If your flight was rescheduled to leave more than one hour early, and you were notified less than 14 days prior, you may be entitled to up to €600 in compensation under EC261/2004 or UK261.

Even if your flight arrived on time or earlier, the inconvenience caused by a sudden schedule change can severely impact your travel plans — missed connections, unexpected accommodation needs, or simply missing the flight entirely.


The Court Case That Changed the Rules

In December 2021, Claimbeacon took legal action against Laudamotion GmbH (a Ryanair subsidiary) after a flight was moved forward by six hours with minimal notice. The airline claimed it had informed the online travel agency (Kiwi.com), but passengers weren’t notified until just four days before departure.

The European Court of Justice ruled in favor of the passengers, declaring that:

  • Flights rescheduled more than one hour early cause comparable inconvenience to cancellations.

  • Airlines are responsible for directly informing passengers, not just intermediaries like travel agents.

This ruling solidified the right to compensation for early departures.


How Much Compensation Can You Claim?

The amount depends on the flight distance and is similar to delay and cancellation compensation:

  • €250 for flights up to 1,500 km

  • €400 for flights between 1,500 and 3,500 km

  • €600 for flights over 3,500 km

These amounts apply to flights covered under EU or UK air passenger regulations.


What If You Missed the Flight Due to the Early Departure?

If the flight left earlier than scheduled and you missed it, you may still be eligible for compensation—especially if you were not informed of the change with sufficient notice.

Even if you managed to catch the flight, the inconvenience of rebooking connections, shifting schedules, or rushing to the airport qualifies for review under EC261.
